These terms govern the use of the ArtsEdu arts education technology platform provided by the developer and company INTECHLEGENT CO., LIMITED.
Acceptance of These Terms
Welcome to ArtsEdu, the arts education technology platform. These Terms of Service form a legally binding agreement between you and INTECHLEGENT CO., LIMITED, the company registered at Rm 510, 5/F, The Cloud, 111 Tung Chau St, Tai Kok Tsui, Hong Kong (HK). By creating an account, viewing our website or using any part of the platform, you agree to these terms.
If you are using the service on behalf of a school, an organisation or any entity, you confirm that you have the authority to bind that organisation to these terms. If you do not have that authority, or if you do not agree with any provision below, you should not create an account or continue to use the service.
These terms should be read together with our Privacy Policy, which explains how personal information is collected and used. Both documents together describe the full deal between us. We may update either document from time to time, and the current versions are always shown on our website with an effective date.
Definitions
Several terms are used throughout these terms and we want them to be clear from the start. The platform or service means the ArtsEdu website at artsedu.lol together with every feature it offers, including virtual studio classrooms, course and curriculum systems, student portfolios, community exhibitions, teacher training and course analytics.
A user is any person who visits our site or who holds an account. A learner is a student enrolled in a course. A teacher is an educator who delivers courses or assesses student work. A school is an educational organisation that registers on the platform to run classes, and an administrator is the person who manages the school account.
We, us and our refer to INTECHLEGENT CO., LIMITED. You and your refer to the account holder, the visitor or the organisation, depending on the context. User content means the art, writing, files, comments and statements that users upload or create while using the platform.
Eligibility to Use the Service
You must be old enough to enter into a binding agreement in the place where you live to create an account in your own name. Where you are younger than that age, you may only use the platform with the involvement of a parent, a guardian or an authorised school that has received proper consent.
Schools are responsible for confirming that they have the legal right to enrol each learner and that any required parental consent has been obtained before a child account is opened. We rely on the information a school provides and we expect schools to keep their own consent records as the law of their region requires.
We may refuse to open or run an account for any lawful reason, for instance where we suspect the misuse of another person identity or where a previous account was terminated for breach of these terms. Our decision in such cases is final, subject to the dispute provisions set out below.
Accounts and Responsibility
When you register, you agree to give us accurate and complete information and to keep that information current. You are responsible for maintaining the secrecy of your password and for every activity that happens under your account. Sharing your login details with anyone else is not permitted.
If you believe your account has been used without your permission, you must tell us immediately at info@artsedu.lol so we can help you secure the account and investigate any unusual activity. Until you do so, we will treat activity under your login as your own for the purposes of these terms.
School accounts may create accounts for teachers and may authorise enrolment of learners under their brand. An administrator is expected to control who holds access within the school and to remove access promptly when a teacher leaves or a learner graduates. We are not liable for losses that flow from a failure to manage internal access properly.
License to Use the Platform
Subject to your compliance with these terms, INTECHLEGENT CO., LIMITED grants you a personal, non-exclusive, non-transferable and revocable permission to access and use the platform for its intended educational purpose. This permission does not make you an owner of any part of the software or content we provide.
You may not copy, reverse engineer, disassemble or attempt to derive the source code of the platform beyond what the law allows. You may not resell, sublicense or offer the service to others as if it were your own, unless you are running your own courses for enrolled learners as permitted by your school plan.
The permission we grant is limited in scope and duration. It lasts for as long as your account is active and in good standing, and it ends automatically if your account is terminated. Certain sections of these terms that are meant to survive an ending, such as the ownership and liability clauses, continue to apply afterwards.
Scope of the Services
ArtsEdu bundles a family of arts education tools. The virtual studio classroom delivers live lessons with video, chat and a shared canvas. The curriculum system organises lessons, assignments and rubrics for art schools. The portfolio platform lets learners gather their work and reflect on growth over time.
Teacher training programs provide self-paced courses and live mentorship for educators. Community exhibitions give learners a curated public wall to show finished works. Course analytics give teachers honest, visual insight into engagement, progress and where learners may need extra support.
We describe these six services as a family because they are designed to work together, but subscriptions may include them individually or in bundles depending on the plan a school selects. Availability of a specific feature may vary by region, by subscription tier and by the device a user chooses, and we may enhance or retire features with reasonable notice where that is needed to keep the platform healthy.
Acceptable Use and Conduct
Our community is built on kindness and respect. You agree not to use the platform to harass, threaten, demean or impersonate any person, and not to publish material that is unlawful, hateful, defamatory or that violates the rights of others. Art rooms should be safe rooms for everyone.
You agree not to attempt to break into the platform, to tamper with the work of others, to probe our security systems or to introduce viruses, worms or other harmful code. You agree not to scrape large volumes of content, to flood the servers, or to interfere with the access of other users.
We may remove content or suspend any account that breaks these conduct rules, and we will normally warn a genuine first mistake where we safely can. Egregious conduct, meaning serious or repeated abuse, may lead to immediate termination without a refund of any unearned fees, as explained further below.
Your Content and Ownership
You keep full ownership of the art and writing you create and upload. Nothing in these terms takes away your copyright or moral rights in your own work. Where multiple people contribute to a shared piece, you are responsible for having the permissions needed to upload it to our platform.
By uploading content, you grant us a limited, worldwide permission to store, display and transmit that content so that the platform can work as designed, for example so a teacher can view a student submission or so an exhibition page can display an artwork. This permission ends for privately held content when you delete it, and for public exhibition content when you remove it from the wall.
You promise that your content does not infringe any copyright, trade mark or privacy right and that it does not break the law. If someone claims that content you uploaded harms them, you are responsible for resolving that claim, although we will make reasonable efforts to notify you about any complaint we receive.
School and Teacher Arrangements
Schools and independent teachers may use the platform to run their own courses. When they do, they act as the organiser of the learning experience and are responsible for the quality and accuracy of the curriculum they publish, the qualifications they claim and the consent they collect.
A school or teacher may grant its administrator and selected staff access to learner records within its own courses. This access is intended to support legitimate teaching and pastoral care, and users must not inspect learner records outside their own responsibilities. We may audit access logs to protect the community.
Where a school requests student data export or deletion, we will respond in line with our Privacy Policy and applicable law. Schools that leave the platform should export materials they wish to keep before the account is closed, as we cannot guarantee access after termination.
Fees, Payment and Renewal
Some parts of the platform are free and some require a paid subscription or a one-time payment, as plainly shown at the point of purchase. All fees are stated in the relevant currency and are exclusive of taxes unless we say otherwise. You are responsible for any taxes that apply to your purchase.
Unless a plan is advertised as one-time only, subscriptions renew automatically at the end of each billing period until you cancel. We will charge the payment method you registered using the then-current price, and we will always tell you before a price rise takes effect so you can decide whether to continue.
If a payment fails, we will try to collect it again and we will alert you through the contact details on file. Continued failure to pay may suspend your access until the account is settled, and repeated failure over an extended period may lead to closure of the account in line with the termination section below.
Trial and Free Access Tiers
We offer free trials and free tiers from time to time so that new users can explore before they pay. A trial begins when a promotional code is applied or an account is first opened under a trial offer, and it runs for the stated period unless it is ended early under these terms.
Free tiers give a genuine taste of the atelier, with some limits on class size, storage or analytics compared with paid plans. We may change the exact allowances of a free tier, or withdraw a trial promotion, with reasonable notice shown on the relevant page. This is a kindness we extend, not a lifetime entitlement.
You may only use one trial per person, per organisation and per payment method unless we clearly state otherwise. We reserve the right to terminate trial accounts that we reasonably believe are created mainly to avoid paying for repeated access beyond what was intended.
Intellectual Property Rights
The platform itself, including its design, code, graphics, course templates and written materials we publish as our own, is protected by intellectual property law and remains the property of INTECHLEGENT CO., LIMITED or its licensors. The ArtsEdu name and logo are trade marks of our company.
Nothing in these terms gives you any right to use our trade marks, logos or names in a way that suggests an affiliation we have not granted. You may of course say that you use ArtsEdu as your teaching platform, but you may not claim that your own materials are produced by us or that we endorse your work.
Where we provide teaching templates, rubrics or worksheets as part of a course, your licence to those materials extends to your own teaching use while your subscription is active. This licence is not a transfer of ownership and does not let you republish our branded templates as products you sell.
Privacy and Data
Your use of the platform is governed by our Privacy Policy, which is part of these terms. That policy tells you what data we collect, why we collect it and the rights you hold over it. We encourage a careful read before you begin because privacy matters to an arts community as much as to anyone.
You accept that lessons may include data such as attendance timestamps and that analytics content belongs to your teacher or school for the purpose of supporting your learning. Where a session is recorded, you will be told in advance and you may usually choose not to appear while still taking part by voice or text.
We act in good faith with the data you trust to us. We do not sell personal data, we limit access to those who need it and we respond to deletion requests in line with law. If you have a privacy question, please contact us at info@artsedu.lol before escalating any concern.
Third-Party Integrations
The platform may offer links to, or integration with, outside tools such as payment processors, video providers and art supply stores. We select these partners with care, but they operate under their own terms and privacy policies, and we are not responsible for how they treat your data once you interact with them.
Where an integration requires you to accept a separate agreement, for instance a payment provider settlement terms, that agreement sits alongside these terms and governs that specific interaction. A conflict between documents will be resolved so that the more specific agreement applies to the feature it covers.
If a third-party integration unexpectedly fails, we will make reasonable efforts to help you find an alternative path and to inform you of the cause. We do not warrant the uninterrupted availability or the fitness of any outside service, because those services are beyond our direct control.
Disclaimers and Availability
The service is provided on an as-is and as-available basis. To the fullest extent the law allows, INTECHLEGENT CO., LIMITED disclaims all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement. We cannot guarantee the platform will never fail or that it will suit every artistic purpose.
We work hard to keep classes online and homework reachable, but we do not promise that the service will be uninterrupted, error-free or free of harmful components. Occasional maintenance windows, network events and third-party failures may interrupt access, and we will tell you about planned maintenance where we reasonably can.
Learning outcomes depend on many factors beyond our software, including the teaching, the effort of the learner and the home environment. We do not guarantee that any learner will achieve a particular grade, portfolio outcome or admission result, and nothing on our site should be read as a promise of certification that we do not ourselves award.
Limitation of Liability
To the fullest extent permitted by law, INTECHLEGENT CO., LIMITED shall not be liable for indirect, incidental, special, consequential or punitive damages, nor for loss of profits, data, goodwill or opportunity, arising out of or in connection with your use of the platform, even if we were told that such damages were possible.
Our total liability for all claims arising in connection with the service, whether in contract, tort or otherwise, will not exceed the greater of the amount you paid us in the twelve months before the claim arose or one hundred United States dollars. This cap applies to our entire responsibility to you.
Nothing in these terms excludes liability that cannot be excluded by law, such as liability for death or personal injury caused by negligence, or liability for fraud. Where a law gives you protection that cannot be waived, these limits do not reduce that statutory protection.
Termination and Suspension
You may close your account at any time through your account settings or by writing to us at info@artsedu.lol. Closing an account does not cancel fees already due for the current billing period, and any prepaid but unused fee will be handled according to the cancellation terms shown at the point of purchase.
We may suspend or terminate your access if you breach these terms, if we must do so to comply with the law, or if continuing to serve you would create a real risk to the safe operation of the platform. Before a serious step we will, where practical and lawful, give you notice and a chance to fix the issue.
Upon termination, your right to use the service ends at once. We will give you a reasonable period to export your own portfolio content so your work is not lost, unless your account was closed for conduct that put the community at risk. Sections of these terms meant to survive, including those on ownership, liability and governing law, continue to apply.
Changes to These Terms
We may revise these terms from time to time to reflect new features, legal developments or the way our business evolves. When we make a material change, we will show the updated date at the top of this page and will give you a clear notice on our website before the change takes effect.
If a change would materially affect an existing agreement, we will give at least a reasonable advance notice so you can decide whether to continue. Where the law requires affirmative consent to a particular change, we will obtain that consent rather than relying on silent acceptance.
Continuing to use the platform after an update is published and noticed means you accept the revised terms. If you do not agree with a new version, your option is to stop using the service and close your account before the change takes effect, so no disputed rule ever applies to you by surprise.
Governing Law and Disputes
These terms are governed by the laws of Hong Kong, without regard to its conflict of law rules. Each party submits to the non-exclusive jurisdiction of the courts of Hong Kong for any dispute arising out of these terms, unless a mandatory rule gives you courts in your own country a stronger entitlement.
Where you are a consumer living in a region whose law gives you protection that cannot be waived, that protection is not displaced by this clause. In that case the governing law and forum that benefit you will apply to the extent the law requires.
Before any court action, we invite you to contact us to try to resolve the matter informally. Many concerns are simple misunderstandings that a friendly conversation can settle. If we cannot agree after a genuine attempt, then either party may proceed through the courts described above or through any other lawful remedy open to them.
